These Terms of Use (the “ToU”) govern access to https://4klip.io and use of the 4Klip service, operated by 4Klip, a sole trader (“4Klip”). Contact: 4klip.contact@gmail.com. They supplement the Terms of Service, which govern subscriptions, prices, minute consumption and the right of withdrawal. Where the two documents conflict on a commercial matter, the Terms of Service prevail; on a matter of service usage, these ToU prevail. Accessing the site and creating an account constitute acceptance of these ToU. This English version is provided for convenience; the French version governs.
1.Purpose and acceptance
These ToU set out the conditions under which any person accessing the site or using the service (the “User”) is permitted to do so, together with the rules of conduct that apply to them. They cover all features, free or paid, including the public pages of the site, the personal account area, the video processing tool, the render library, support, and where applicable the affiliate programme.
Using the service requires internet access, a recent browser and compatible hardware, the cost and proper functioning of which remain the User's responsibility. Certain features may be unavailable on certain browsers, systems or configurations, without this constituting a breach by 4Klip.
4Klip may amend these ToU for legitimate reasons, in particular changes to the service, to applicable regulations or to its providers. Any substantial change is notified to Users holding an account, by email or by a notice displayed in the account area, at least 30 days before it takes effect. A User who does not accept the change may stop using the service and close their account before that date, without losing the rights they hold under the Terms of Service in respect of a current subscription.
2.User account
An account is required to use the processing features. The User undertakes to provide accurate, complete and up-to-date information, in particular a valid email address under their effective control, and to keep it current. An invalid, inaccessible or misappropriated email address prevents delivery of the service and of legal, contractual and security notices.
The User declares that they are at least fifteen years old. Registration is prohibited below that age. Between fifteen and eighteen, registration and any purchase require the prior authorisation of the holder of parental authority, which 4Klip is entitled to request. 4Klip deletes any account shown to have been created in breach of this clause.
The account is strictly personal. The User is responsible for keeping their credentials confidential and for all activity carried out from their account. They must inform 4Klip without delay, at 4klip.contact@gmail.com, of any unauthorised use or suspected compromise. Sharing credentials, pooled use of an account by several persons or entities, and the creation of multiple accounts by the same person in order to obtain several minute quotas, promotional offers or trial periods are prohibited.
The User may close their account at any time from their settings or by writing to 4Klip. Closing the account ends access to the service and deletes hosted files under the conditions set out in the Privacy Policy, subject to data 4Klip is required to retain under a legal obligation, in particular accounting obligations. Closing the account does not in itself entitle the User to a refund of amounts already due for a current subscription period or of processing already performed.
3.User content and intellectual property
The User remains the sole and full owner of the videos, images, sound and other content they upload to the service (the “Content”), as well as of the files returned after processing. 4Klip claims no ownership over the Content or the renders.
The User warrants that they hold all rights, licences, permissions and consents necessary to upload and process each item of Content, including without limitation rights in third-party footage, in music and soundtracks, in trade marks, logos and works appearing therein, as well as the permissions of identifiable individuals appearing on screen in respect of their image rights and data protection rights. This warranty is confirmed by an express declaration made by the User before each job; that declaration is recorded and retained by 4Klip as evidence.
The User grants 4Klip, solely for the purposes of performing the service they request, a non-exclusive, worldwide, non-transferable and strictly temporary licence to host, reproduce, transcode, segment, technically modify and transmit the Content to its infrastructure providers. This licence is limited to what is technically necessary to process the file, deliver the render and operate the service; it ends when the relevant files are deleted.
4Klip does not use User Content to train, fine-tune or evaluate artificial intelligence models, nor for advertising, promotional or demonstration purposes, save with the User's express, prior, specific and revocable consent, collected separately and withdrawable at any time without affecting delivery of the service.
The User shall indemnify 4Klip against any third-party claim, action, complaint, proceedings or award, together with reasonable and evidenced defence costs arising therefrom, based on Content they uploaded, in particular in matters of infringement, image rights, defamation, privacy or data protection. 4Klip shall inform the User of any such claim within a reasonable time and allow them to take part in the defence.
4.Acceptable use — prohibited content
It is prohibited to upload, process, store or distribute through the service any content that infringes a third party's rights, in particular content protected by copyright, by a related right or by trade mark rights and for which the User holds neither the rights nor a sufficient licence, including extracts from films, series, broadcasts, sports coverage, music videos and musical soundtracks.
Also prohibited, without limitation: any child sexual abuse material or content sexualising a minor; any non-consensual sexual content, including intimate content distributed without the consent of the person concerned; any content inciting hatred, violence, terrorism, genocide or discrimination on the basis of origin, sex, sexual orientation, gender identity, disability, religion or membership of a nation or ethnic group; any content glorifying crimes against humanity; any content undermining human dignity.
Content designed to make the public believe, without this being clearly disclosed, that a real person said or did something they did not is prohibited, in particular where it serves to impersonate them, defame, humiliate or blackmail them, deceive others, influence an election or commit fraud. Content intended for fraud, phishing, false advertising or market manipulation is prohibited, as is content breaching the rules applicable to advertising, health, gambling, financial products or crypto-assets.
The User remains solely responsible for their use of the returned files, in particular their publication on third-party platforms, compliance with those platforms' own terms, and compliance with transparency obligations applicable to content generated or modified by artificial intelligence. 4Klip carries out no systematic prior review of Content, which implies no waiver of its right to act once manifestly unlawful content is brought to its attention.
5.Acceptable use — technical prohibitions
It is prohibited to circumvent, attempt to circumvent or neutralise the technical limits of the service, in particular minute quotas, file size or duration restrictions, quality tiers reserved to certain plans, rate limits and access controls. Prohibited practices include creating multiple accounts, using fictitious, disposable or misappropriated identities or email addresses, and exploiting a flaw or a display error to obtain processing, a quota or a price to which the User is not entitled.
It is prohibited to access the service by any automated means not expressly authorised, including bots, scripts, automated extraction, scraping or harvesting; to call the service's technical interfaces outside the use provided for by the interface; to carry out load testing, vulnerability scanning or intrusion without prior written authorisation; and to disrupt or attempt to disrupt the availability, integrity or security of the service and its infrastructure.
It is prohibited to resell, rent, sublicense, make available to a third party, pool or operate the service on behalf of third parties under a separate brand, other than under a specific written agreement with 4Klip. In particular, offering a video processing service to clients on the back of a personal 4Klip subscription is prohibited.
It is prohibited to decompile, disassemble or reverse-engineer the service, to extract its models, parameters, weights or processing configurations, to reproduce all or part of 4Klip's interface, code, text, visuals or visual identity, or to use the renders produced to train a competing model, save to the extent mandatorily permitted by law, in particular for interoperability purposes.
6.Availability, maintenance and changes
4Klip endeavours to keep the service accessible 24 hours a day, 7 days a week, without being contractually bound to do so beyond any commitments separately entered into. Access may be suspended or degraded for maintenance, updates, migration or security work; where a planned interruption is significant, 4Klip endeavours to inform Users in advance by an appropriate means.
The service relies on third-party infrastructure providers, in particular for application hosting, GPU compute, file storage and payment. A failure, saturation, unilateral change or interruption at any of these providers may affect the availability or performance of the service. 4Klip applies reasonable diligence to restore the service and, where applicable, to restore minutes debited for a job made impossible by such a failure.
4Klip may develop the service and add, modify or withdraw features, in particular where changes in models, infrastructure costs or regulation justify it. Where a change removes or substantially and lastingly degrades an essential feature of a current subscription, a consumer User may terminate their subscription under the conditions set out in the Terms of Service and obtain a pro rata refund of the period already paid for and not consumed.
Features identified as experimental, in testing or in early access are provided as is, may be modified or withdrawn at any time and carry no availability commitment, without prejudice to the statutory guarantees owed to consumers.
7.Moderation, suspension and termination
In the event of a breach of these ToU, 4Klip may, depending on the seriousness and repetition of the breach, issue a warning, refuse or stop a given job, remove manifestly unlawful content, restrict access to certain features, suspend the account or, as a last resort, terminate it.
Except where the breach is manifestly unlawful, presents an immediate risk to security, to a third party or to the infrastructure, or where a court decision or legal obligation so requires, 4Klip informs the User beforehand of the alleged facts and of the measure contemplated, and allows them a reasonable time to submit observations or remedy the situation. Any measure taken is reasoned and notified to the User, who may challenge it by writing to 4klip.contact@gmail.com; the challenge is examined by a person other than the one who took the measure where the organisation allows.
Termination for a serious and established breach — in particular uploading manifestly unlawful content, fraud, deliberate and repeated circumvention of technical limits, or unauthorised resale of the service — takes effect immediately. It gives rise to no refund of processing already performed or minutes already consumed. The balance of the current subscription period is refunded pro rata only where the measure proves unfounded.
Termination or suspension of the account does not prevent 4Klip from exercising its other rights and remedies, nor from retaining the material strictly necessary to establish, exercise or defend a legal claim and to comply with its legal obligations.
8.Reporting unlawful content or copyright infringement
Any person who considers that content processed through the service infringes their rights, in particular copyright, a related right, trade mark rights, image rights or privacy, may report it to 4Klip at 4klip.contact@gmail.com. The report should state the identity and contact details of its author, a precise description of the content complained of and its location, the reasons why it should be removed, and where applicable evidence of the rights relied on.
4Klip acts promptly to remove or disable access to any content whose manifestly unlawful character is notified to it on those terms, in accordance with the regime applicable to hosting providers. 4Klip informs the User concerned, who may submit observations and, if they can evidence the necessary rights, request reinstatement of the content.
Submitting a report the author knows to be inaccurate in order to obtain the removal of lawful content engages that author's liability. Manifestly abusive or repeated reports may be set aside.
Requests from a competent administrative or judicial authority are handled in accordance with applicable law.
9.4Klip's intellectual property
The service, the site, their architecture, code, databases, interfaces, text, graphic elements and visual identity, together with the 4Klip trade mark and domain name, are protected by intellectual property law and remain the exclusive property of 4Klip or its licensors.
4Klip grants the User, for the duration of their registration and for their own needs only, a personal, non-exclusive, non-assignable and non-sublicensable right to use the service, to the exclusion of any other right. Nothing in these ToU may be construed as transferring any intellectual property right to the User.
Certain third-party software components used by the service are distributed under open-source licences; 4Klip's use of those components complies with the applicable licences, a list of which may be provided on request.
10.Personal data
The processing of the User's personal data is described in the Privacy Policy, accessible from the site, which sets out in particular the purposes pursued, the legal bases, the categories of data processed, the recipients, retention periods, any transfers outside the European Union and the rights available to the User.
The User exercises their rights of access, rectification, erasure, restriction, objection and portability by writing to 4klip.contact@gmail.com. They also have the right to lodge a complaint with the competent supervisory authority, in France the Commission nationale de l'informatique et des libertés.
Where the User uploads a video featuring identifiable individuals, they act as controller in respect of those individuals and it is for them to have an appropriate legal basis and to inform those individuals; 4Klip acts in that respect as processor, solely for the purposes of performing the service.
11.Liability
4Klip is liable, under general law, for direct damage caused to the User by a breach of its obligations. Nothing in these ToU limits or excludes 4Klip's liability for wilful misconduct, gross negligence, death or personal injury, nor under the statutory guarantees of conformity and against hidden defects owed to consumers, nor in any other case where the law prohibits such limitation.
4Klip is not liable for damage resulting from content uploaded by the User, from use of the service contrary to these ToU, from loss of files of which the User kept no copy, from the act of a third party, from a failure of the internet network or of the User's hardware, nor for the consequences of a decision taken by a third-party platform regarding a video published by the User.
The service is neither a backup nor an archiving service. It is for the User to keep a copy of their original files at all times and to download their renders within the stated retention periods.
12.Governing law, complaints and disputes
These ToU are governed by French law. If the User is a consumer resident in another EU Member State, that choice does not deprive them of the protection afforded by the mandatory provisions of the law of their country of habitual residence.
Any complaint should first be sent to 4Klip at 4klip.contact@gmail.com. 4Klip undertakes to acknowledge receipt and to respond within a reasonable time.
Failing an amicable solution, a consumer User may use consumer mediation free of charge by writing to 4klip.contact@gmail.com, which will indicate the competent ombudsman. They may also use the European online dispute resolution platform. Recourse to mediation is optional and does not prevent court proceedings.
Failing amicable settlement, the dispute shall be brought before the competent court. A consumer User may bring proceedings, at their choice, before the court of the place where they resided when the contract was concluded or when the harmful event occurred, or before the court of the defendant's domicile.
If any provision of these ToU is held void, deemed unwritten or unenforceable, the remaining provisions retain full effect. 4Klip's tolerance of a breach does not amount to a waiver of its right to rely on it later.
